By purchasing products from Yopie’s Store or using this website you (“the Customer”), agree to the following terms and conditions:

1.    Where the provisions of the Consumer Guarantees Act 1993 apply, these terms will be read subject to the application of that Act, and in the case of any conflict the provisions of that Act will apply.

2.    Notwithstanding point 1 above, the Consumer Guarantees Act 1993 does not apply to “business” customers (as defined by the Act).  Business customers agree that where products are purchased for the purpose of a business the Consumer Guarantees Act does not apply.  

3.    Yopie’s Store makes every effort to display the products available through our website as accurately as possible.  However, actual colours of products as viewed on your computer monitor may differ from actual product colour.

4.    Yopie’s Store makes every effort to ensure only those products readily available are displayed on our site.  However, product availability is reliant in some circumstances on third party suppliers.  Where information provided by third parties is inaccurate some errors are expected.

5.    Yopie’s Store makes every effort practical to ensure that delivery takes place in a timely manner. In usual circumstances we endeavour to dispatch goods within three (3) to five (5) working days with receipt by you within five (5) to seven (7) working days. Rural delivery may take longer. However, by placing an order, you agree that Yopie’s Store will not be liable for any loss or damage directly or indirectly arising out of or in connection with any delay or failure to deliver within the indicated timeframe.

6.    Yopie’s Store accepts credit card or payment online via our secure server.  If you wish to pay by direct credit please contact us.  While this latter option is available Yopie’s Store will not accept any responsibility for the Customer crediting money to the incorrect bank account number where the correct number was provided to the Customer by Yopie’s Store.  In such a situation the products ordered will not be dispatched.

7.    For New Zealand delivery addresses all prices are New Zealand GST inclusive, unless otherwise stated.  If your order ships to a delivery address outside New Zealand, the Customer is the importer on record and will be responsible for all customs, import duties and sales tax charges.  These charges vary in each country and are outside of Yopie’s Store’s control.  Contact your local customs office for more information on what import duties or sales taxes may be imposed.

8.    If you, for whatever reason, are unhappy with your purchase, you may return your goods with receipt within 21 days of purchase.  In such circumstances, Yopie’s Store will be happy to offer an exchange, credit note or refund for the returned goods.  All returned goods must be in an unused, unwashed condition and in original packaging.  Please do not break open packaging that is non-resealable if you wish for an exchange or refund.  With the exemption of faulty goods, Yopie’s Store will not refund postage and packaging.

9.    If a product is found to be misaddressed by Yopie’s Store, then Yopie’s Store will be responsible for the redelivery, replacement or refunding of the product.  If the Customer is found to have given an incorrect or insufficient address, Yopie’s Store will not refund or resend the product and all responsibility for correct delivery will be borne by the Customer.

10.    By placing an order with Yopie’s Store and/or creating an account, you consent to receiving electronic communications from Yopie’s Store.  These communications will include, but will not be limited to, account status updates, order status updates, promotional and marketing materials, and other information relating to Yopie’s Store.  Your personal details will not be made available to any third party.  For more information please see our Privacy Policy.

11.    All Intellectual Property in this website, including texts, images, graphics, arrangement and encompassing design of this website belongs to Yopie’s Store, unless otherwise stated.  You are permitted to view, copy and print from this website for your personal use only.  Yopie’s Store does not permit reproduction, adaption or the use of this website incorporated/or linked in any other work without the written consent of Yopie’s Store.

12.    All information, products and services provided on this website is provided in good faith.  Yopie’s Store has exercised all reasonable care to ensure this site is user-friendly and secure.  Accordingly, Yopie’s Store does not accept liability for any loss or damage which may directly or indirectly result from any information, products, opinion or representations contained on this website.  The Customer also hereby indemnifies Yopie’s Store against any loss of or damage to property or for data or software which is lost, corrupted, deleted or altered.

13.    Yopie’s Store does not accept liability for any loss or damage which may directly or indirectly result from products supplied by Yopie’s Store.
